After years of democracy and struggle for rights, especially after the Second World War, many states accepted human rights in their constitutional texts, almost as an apology to humanity. Thus, due to the violations of rights during the First and Second World War, the individual was sought to be protected by bringing it after the wars to the fore. As a result of these developments, the constitutional judiciary, an institution that was born within the scope of constitutionalism activities for the purpose of protecting democracy and human rights, has gained immense importance and has become a frequently discussed and current issue.
